Components of Employment Agreements
Under the present legal system, an employee’s terms and conditions of employment are made up of three distinct components:
- Express Terms (i.e. those matters discussed, agreed on and then confirmed in writing).
- Incorporated Terms (i.e. those entitlements created by legislation that are deemed to form part of the employment contract/agreement).
- Implied Terms (i.e. those entitlements created by either custom and practice or Court precedent)
